1. Who We Are

SmileBros (“SmileBros,” “we,” “us,” “our”) sells custom-made dental products directly to consumers through the Site.

2. Eligibility

You must be at least 18 years old (or the age of majority in your state) to place an order. If you are ordering on behalf of another person, you represent you have permission to do so.

3. Medical and Dental Disclaimer

SmileBros products are not a substitute for professional dental or medical care. The Site provides general information and product descriptions, not medical advice. If you have pain, swelling, bleeding, a suspected infection, or a medical emergency, seek care from a licensed professional.

You are responsible for determining whether a product is appropriate for your needs.

4. Orders, Custom Products, and Fit

Many SmileBros products are custom-made based on impressions you provide. Custom products are created specifically for you and cannot be resold.

By ordering, you understand:

  • The accuracy of fit depends on the quality of the impressions you submit.
  • Comfort and fit may require an adjustment period.
  • Your teeth, gums, and bite can change over time, which can impact fit.

We may reject impressions that are incomplete or unusable. If that happens, we will provide instructions for next steps.

5. Pricing, Payment, and Taxes

Prices are shown on the Site and may change at any time. You authorize us to charge your selected payment method for your order total, including applicable taxes and shipping fees.

If a payment is declined or reversed, we may cancel the order or pause production.

6. Shipping and Delivery

Shipping timelines and production timelines vary by product and are shown during checkout or on product pages. Delivery dates are estimates and not guaranteed.

Risk of loss passes to you upon delivery to the shipping carrier, to the extent permitted by law.

7. Returns, Refunds, and Cancellations

Because many products are custom-made, returns and refunds may be limited or not available except where required by law or where explicitly stated in writing on the Site.

If you need to change or cancel an order, contact support immediately. Once production begins, changes or cancellations may not be possible.

8. Warranty

Warranty terms are provided on our Warranty page and may vary by product. The warranty generally covers defects in materials or workmanship under normal use and does not cover normal wear and tear, misuse, accidental damage, or changes in fit due to changes in your mouth.

9. Promotions and Discount Codes

Discount codes and promotions may have restrictions, expiration dates, and product exclusions. We may modify or end promotions at any time.

10. Account, Site Use, and Prohibited Conduct

You agree not to:

  • Use the Site for unlawful purposes
  • Attempt to interfere with the Site’s security or operation
  • Submit false information or impersonate others
  • Copy, scrape, or exploit Site content without permission 

We may suspend or block access for suspected misuse.

11. Intellectual Property

All Site content, including text, graphics, logos, product names, and design elements, is owned by SmileBros or its licensors and is protected by applicable intellectual property laws. You may not use our content without written permission.

SMILEBROS’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM.

Some states do not allow certain limitations, so these limits may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless SmileBros from claims, damages, liabilities, and expenses arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.

17. Dispute Resolution and Governing Law
